These Terms of Service (the “Terms”) govern your access to and use of the News Trader website at newstrader.io and all related services (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Regulatory status and important disclaimer

News Trader is not authorised, regulated, or supervised by the Central Bank of Ireland or any other financial regulatory authority. The Service does not constitute, and should not be construed as, “investment advice” or an “investment recommendation” within the meaning of Regulation (EU) No 596/2014 (Market Abuse Regulation), Directive 2014/65/EU (MiFID II), or any Irish or EU financial services legislation.

The Service provides automated, algorithm-generated market commentary and educational information only. No content on the Service constitutes a personal recommendation to buy, sell, or hold any financial instrument. No content constitutes financial advice, investment advice, trading advice, legal advice, or tax advice. You must not rely on any output of the Service as a basis for making investment decisions.

Trading and investing carry a high level of risk. You may lose some or all of your invested capital. Past performance (including any win rate, score, or historical outcome displayed by the Service) is not a reliable indicator of future results.

Eligibility and accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You agree to provide accurate, current, and complete information and to keep it up to date.

Subscriptions, billing, and cancellations

  • Paid plans are billed in advance through our payment processor, Stripe. Stripe’s terms apply to payment processing.
  • All prices are displayed inclusive of VAT where applicable. Additional taxes may apply depending on your jurisdiction.
  • You may cancel your subscription at any time from your account settings. Upon cancellation, access continues until the end of the current paid billing period. No partial refunds are given for unused portions of a billing period.
  • We may change prices or plan features upon at least 30 days’ prior notice. If you do not agree to a price change, you may cancel before it takes effect.

Right of withdrawal (EU/EEA consumers)

Under the European Union (Consumer Rights) Regulations 2013 (S.I. No. 484/2013) and the Consumer Rights Act 2022, if you are a consumer in the EU/EEA, you have the right to withdraw from your subscription within 14 days of purchase without giving any reason. To exercise this right, contact us at [your-email@domain.com] with a clear statement of your decision to withdraw. If you have already accessed the digital content during the withdrawal period, you acknowledge that you may lose the right of withdrawal to the extent the Service has been provided.

Acceptable use

You agree not to:

  • Use the Service in a way that violates applicable laws or regulations.
  • Attempt to interfere with, disrupt, or gain unauthorised access to systems or networks.
  • Reverse engineer, decompile, or attempt to extract source code except where expressly permitted by applicable law (including the European Communities (Legal Protection of Computer Programs) Regulations 1993).

  • Upload or transmit malicious code, or attempt to bypass security features.
  • Redistribute, republish, or resell Service content or outputs to third parties.

Intellectual property

The Service and its content (including software, design, text, graphics, and trademarks) are owned by News Trader or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial purposes, subject to these Terms. This licence does not grant you any rights to sub-license or transfer access to any third party.

Third-party services and data

The Service may link to or integrate with third-party services (for example, market data providers, news sources, and payment processors). We do not control and are not responsible for third-party services, their accuracy, or their availability. Market data displayed may be delayed, indicative, or sourced from third parties and should not be relied upon for trading purposes. Your use of third-party services is governed by their own terms and policies.

Disclaimers

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW (INCLUDING THE SALE OF GOODS AND SUPPLY OF SERVICES ACT 1980, THE CONSUMER RIGHTS ACT 2022, AND EU CONSUMER PROTECTION LAW), THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY ALERTS, ANALYSIS, SCORES, OR OTHER OUTPUTS.

Nothing in these Terms excludes or limits any warranty, condition, or liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer under Irish and EU law.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • News Trader shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or trading losses, arising from or related to your use of (or inability to use) the Service.
  • Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the total amount you have actually paid to News Trader in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred euro (€100), whichever is greater.
  • Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under Irish or EU law.

You acknowledge that the Service provides automated, algorithmically generated information and that investment decisions involve inherent risks. You accept full responsibility for any trading or investment decisions you make.

Your responsibility

You are solely responsible for evaluating any information or output provided by the Service and for any actions you take based on such information. You should seek independent professional financial advice from a suitably qualified and regulated advisor before making any investment decisions. You agree that any reliance on Service outputs is at your own risk.

Termination

We may suspend or terminate your access to the Service if you breach these Terms or if we reasonably believe your use poses a security, legal, or operational risk. We will endeavour to give you reasonable notice where practicable. You may stop using the Service and close your account at any time.

Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland. If you are a consumer habitually resident in an EU/EEA Member State, you may also have the benefit of any mandatory consumer protection provisions of the law of that Member State, and you may bring proceedings in the courts of that Member State.

Online dispute resolution

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, Cookie Policy, and Disclaimer, constitute the entire agreement between you and News Trader regarding the Service and supersede all prior agreements and understandings.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
